Last Updated: 10/30/2026
Organization: Raíces Sin Fronteras
Fiscal Sponsor: Tri-County Health Network, doing business as Thrive Community Health Network
Contact: raicescolorado@gmail.com

1. Purpose and Scope
These Terms and Conditions ("Terms") govern access to the Raíces Sin Fronteras website and registration platform and participation in workshops, classes, community gatherings, educational activities, wellness programs, cultural events, and related activities (collectively, "Programs").
The Terms apply to website visitors, registrants, participants, parents and legal guardians registering minors, and other individuals who use Raíces services.
Additional activity-specific rules, safety requirements, facility policies, consent forms, and liability releases may apply.
By affirmatively accepting these Terms during registration, the registering adult agrees to comply with their applicable provisions.
Website access alone does not constitute execution of a participation liability release.
2. Organizational Identity and Fiscal Sponsorship
Raíces Sin Fronteras ("Raíces") is an unincorporated community organization operating for lawful nonprofit, educational, cultural, wellness, and community purposes.
Raíces receives fiscal sponsorship from Tri-County Health Network, doing business as Thrive Community Health Network ("Thrive").
The parties' legal responsibilities are determined by applicable law, their actual conduct, and their written fiscal sponsorship and operational agreements.
Fiscal sponsorship does not, by itself, establish that Thrive directly supervises every workshop, instructor, volunteer, or facility.
Nothing in these Terms creates a partnership, agency relationship, employment relationship, or assumption of responsibility beyond that otherwise established by law or agreement.
3. Protected Parties
For purposes of the applicable release and protective provisions, "Protected Parties" means, to the extent involved in the relevant Program:
Raíces Sin Fronteras and its legally recognized association, if applicable;
Tri-County Health Network, doing business as Thrive Community Health Network;
Their respective members, organizers, directors, officers, trustees, employees, coordinators, administrators, and authorized representatives;
Volunteers, volunteer coordinators, assistants, interns, and other authorized unpaid personnel;
Instructors, facilitators, educators, presenters, and independent contractors;
Participating organizations, collaborating partners, and authorized service providers;
Participating property owners, landlords, facility operators, and venue personnel identified in the applicable Program materials;
Authorized website developers, software providers, technical administrators, and maintenance contractors acting within the scope of their authorized services;
Their lawful successors and assigns, where applicable.
Each properly identified Protected Party is an intended third-party beneficiary of applicable protective provisions to the extent permitted by law.
These Terms do not independently create insurance coverage or an obligation for any third party to defend or indemnify another.
4. Eligibility and Age Requirements
Participation is subject to applicable eligibility, capacity, age, supervision, and safety requirements.
Unless a workshop states otherwise, the age categories are:
Children: 12 years and younger.
Youth: 13 through 17 years.
Adults: 18 years and older.
Age eligibility is determined as of the workshop date.
Participants must satisfy the published age requirements.
Raíces may lawfully restrict workshops to designated age categories based on legitimate educational, developmental, safety, or operational considerations.
Knowingly misrepresenting a participant's age is prohibited and may result in immediate cancellation or removal.
5. Accuracy of Registration Information
Registrants must provide accurate, complete, and truthful information in all material respects.
Prohibited conduct includes:
Misrepresenting age or identity;
Misrepresenting parental or legal guardianship authority;
Impersonating another person;
Falsifying consent or signatures;
Knowingly submitting materially inaccurate emergency contact information;
Registering an ineligible participant under another person's identity;
Circumventing a prior lawful exclusion or suspension;
Using duplicate or fraudulent registrations to bypass capacity limits;
Knowingly concealing material information specifically and lawfully requested to determine eligibility or safety.
Raíces may reasonably verify information when an objective concern arises.
Material misrepresentation may result in cancellation, suspension, removal, or other lawful action.
Innocent errors may be corrected without penalty where appropriate.
6. Registration of Minors
Every participant younger than 18 must be registered by a parent or legally authorized guardian.
The registering adult represents that they:
Have legal authority to register the minor.
Have authority to execute the applicable participation documents.
Are not prohibited by a relevant court order from providing the required consent.
Have provided accurate information.
Will complete all required waivers and consents.
Will follow applicable supervision, emergency contact, and pickup procedures.
Will communicate applicable participation rules to the minor.
Raíces may request reasonable verification when a legitimate dispute concerning guardianship or custody arises.
A person who lacks the required authority may not execute participation documents on behalf of a minor.
Raíces may suspend registration while a material authority dispute is evaluated.
7. Responsibility for Waivers and Required Documents
The registrant, or the authorized parent or legal guardian of a minor, is responsible for reviewing and completing all applicable participation documents before the required deadline.
Documents may include:
Raíces participation waivers;
Activity-specific releases;
Parental or guardian consent;
Facility or location waivers;
Equipment or transportation authorizations;
Required safety acknowledgments.
Registration confirmation does not establish that all required documents have been completed.
Failure to complete required documentation may result in:
Cancellation of registration;
Denial of admission;
Release of the reserved space;
Reassignment of the space to an eligible waitlisted participant.
Raíces may establish reasonable submission deadlines.
Administrative reminders may be provided as a courtesy, but failure to receive a reminder does not eliminate the registrant's responsibility to complete the required documentation.
Raíces remains responsible for administering its own lawful verification procedures.
8. No Guarantee of Admission
Submission or confirmation of a registration does not create an unconditional right to participate.
Participation remains subject to applicable eligibility, capacity, safety, documentation, conduct, and operational requirements.
Raíces may refuse or cancel participation for legitimate reasons described in these Terms, consistent with applicable law.
9. Cancellation, Suspension, Removal, and Exclusion
Raíces reserves the right to refuse, cancel, suspend, restrict, or terminate participation when supported by a legitimate and lawful safety, conduct, eligibility, legal, or operational reason.
Such reasons may include:
A. Disruptive or Dangerous Conduct
Threats, intimidation, or violence;
Harassment, stalking, or bullying;
Sexual misconduct;
Repeated or serious disruption;
Aggressive or abusive behavior;
Theft, vandalism, or deliberate property damage;
Unsafe or unauthorized equipment use;
Refusal to comply with reasonable safety instructions;
Conduct presenting an objectively reasonable safety risk.
B. Registration and Eligibility Violations
Material misrepresentation;
Fraudulent consent;
Inaccurate age or identity information;
Unauthorized registration of minors;
Missing required waivers;
Circumvention of a lawful prior exclusion;
Failure to satisfy essential eligibility requirements.
C. Legal and Interpersonal Conflicts
An applicable protection or restraining order;
An enforceable no-contact restriction;
A lawful trespass notice affecting the host location;
Credible threats or documented harassment involving a participant, volunteer, instructor, facilitator, employee, or host facility;
A demonstrated conflict creating an objectively reasonable safety concern that cannot be adequately managed through appropriate measures.
D. Operational Circumstances
Capacity limitations;
Instructor or volunteer unavailability;
Facility closure;
Funding or staffing changes;
Weather emergencies;
Public health or safety concerns;
Workshop cancellation or relocation;
Other legitimate circumstances materially affecting lawful or safe Program operation.
Raíces may consider conduct occurring outside a Program when the conduct has a substantial and demonstrable connection to Program safety.
Exclusion shall not be based merely on personal dislike, unsupported allegations, a disability, a protected characteristic, a request for accommodation, or a good-faith complaint.
10. Protective Orders, Trespass, and Legal Restrictions
Participants must comply with all applicable court orders and lawful restrictions.
Raíces may request appropriate information concerning an order or restriction when reasonably necessary to assess its application.
Where credible information indicates a potential legal conflict, Raíces may impose temporary protective measures while reviewing the circumstances.
Measures may include separation, schedule changes, alternate participation arrangements, temporary suspension, or cancellation.
Raíces is not required to adjudicate disputed allegations or independently determine the validity of a contested court order.
Decisions shall be based on objectively relevant circumstances and applicable law.
Nothing requires Raíces to knowingly facilitate a violation of an enforceable court order or lawful facility restriction.
11. Immediate Safety Action
Authorized personnel may require an individual to stop participating or leave when reasonably necessary to address an imminent threat or serious disruption.
Emergency services or law enforcement may be contacted when appropriate.
Personnel shall not use physical force except as permitted by law.
For minors, Raíces shall follow applicable safeguarding, supervision, and safe-release procedures.
12. Nondiscrimination and Equal Opportunity
Raíces prohibits unlawful discrimination, harassment, and retaliation.
Participation decisions shall comply with applicable federal, Colorado, and local civil rights laws.
Protected characteristics may include race, color, national origin, ancestry, religion, creed, sex, sexual orientation, gender identity, gender expression, disability, and other characteristics protected by applicable law.
Raíces may establish lawful Program-specific eligibility requirements.
No participant shall be excluded for a discriminatory or retaliatory reason.
13. Accessibility and Reasonable Accommodations
Raíces is committed to providing accessible Programs consistent with applicable disability rights laws, including the Americans with Disabilities Act, Colorado Anti-Discrimination Act, and Section 504 of the Rehabilitation Act where applicable.
Individuals may request reasonable accommodations during registration or by contacting [ACCESSIBILITY CONTACT].
Participants generally are not required to disclose a medical diagnosis merely to request an accommodation.
Raíces will assess requests individually and in good faith.
Where required by law, Raíces will provide reasonable modifications, effective communication, and appropriate auxiliary aids or services.
A modification may be declined only when a legally recognized exception applies, such as a fundamental alteration or undue burden under the governing standard.
Advance notice is encouraged but is not an absolute condition for receiving an accommodation that can reasonably be provided.
14. Disability-Related Safety Assessments
Where applicable law permits exclusion based on a direct threat, Raíces will use an individualized assessment based on objective evidence.
The assessment shall consider the nature, duration, and severity of the risk, the probability of harm, and whether reasonable modifications would sufficiently mitigate the risk.
Disability status, diagnosis, stereotypes, or generalized fears alone shall not justify exclusion.
15. Service Animals and Accessible Facilities
Service animals shall be permitted where required by law.
Raíces and participating facilities shall evaluate applicable accessibility responsibilities.
An independently owned facility does not automatically eliminate accessibility obligations applicable to Raíces or the facility operator.
Reasonable accessible alternatives will be considered where required.
16. Language Access
Raíces seeks to provide Program information in English and Spanish.
Where applicable law requires language assistance or effective communication, Raíces will comply with those requirements.
Participants may request assistance understanding registration materials or workshop instructions.
17. Volunteers, Instructors, and Facilitators
Volunteers, instructors, facilitators, and authorized personnel must comply with applicable Program rules, safeguarding policies, confidentiality requirements, and lawful safety procedures.
Prohibited conduct includes:
Harassment or intimidation;
Discrimination;
Sexual misconduct;
Exploitation of participants;
Inappropriate boundaries with minors;
Unauthorized disclosure of participant information;
Retaliation against good-faith complainants;
Acting beyond authorized responsibilities in a manner that endangers participants.
Raíces may remove, suspend, or reassign personnel when supported by legitimate safety, conduct, or operational concerns.
18. Supervision of Children and Youth
Workshop descriptions shall identify applicable supervision requirements.
A parent or guardian may register multiple minors, subject to capacity and eligibility.
A supervising adult does not automatically count toward participant capacity when the workshop expressly provides otherwise.
Unless a Program expressly undertakes defined supervision responsibilities, parents and guardians remain responsible for their minors' supervision and personal needs.
Where Raíces accepts temporary supervision, it shall implement appropriate safeguarding, emergency contact, and pickup procedures.
No provision disclaims a duty actually undertaken or imposed by law.
19. Authorized Pickup and Custody Disputes
For supervised youth Programs, Raíces may establish authorized pickup procedures.
Personnel may require reasonable identity verification before releasing a minor.
A minor shall not knowingly be released to an unauthorized person.
When credible custody or protective-order concerns arise, Raíces may contact the appropriate guardian, emergency contact, or authority.
20. Assumption of Inherent Risks
Participants understand that activities may involve inherent risks.
Depending on the workshop, these may include:
Slips, falls, and accidental collisions;
Physical exertion and fatigue;
Cuts, burns, and equipment-related injuries;
Food allergies or foodborne illness;
Exposure to communicable illness;
Emotional discomfort;
Environmental and weather-related hazards;
Property damage or loss;
Actions of other participants;
Unexpected medical emergencies.
Participants voluntarily accept inherent risks ordinarily associated with the chosen activity, subject to applicable law.
This acknowledgment alone does not release claims for negligence.
21. Separate Release of Ordinary Negligence
IMPORTANT: PARTICIPATION MAY REQUIRE SIGNING A SEPARATE RELEASE OF LEGAL CLAIMS, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE.
Where permitted by Colorado law, adult participants may execute a separate release expressly covering ordinary negligence by identified Protected Parties in connection with a specified Program.
For minors, a parent or legally authorized guardian must execute any required release in accordance with applicable law, including C.R.S. § 13-22-107.
No release shall be construed to waive gross negligence, recklessness, willful or wanton misconduct, intentional wrongdoing, or claims that cannot legally be waived.
Acceptance of these general Terms does not independently execute an activity-specific negligence release.
22. Medical and Emergency Matters
Unless expressly identified otherwise, Raíces does not provide individualized medical treatment or professional medical advice.
Participants should assess their own ability to participate safely and consult appropriate professionals when necessary.
In emergencies, authorized personnel may contact emergency services and provide reasonable assistance within the scope of their training and legal authority.
No particular medical response time or outcome is guaranteed.
Participants remain responsible for medical expenses legally attributable to them, subject to applicable law.
23. Wellness, Mental Health, and Educational Content
Workshop information is generally educational.
Unless expressly provided by an appropriately authorized professional, attendance does not establish a physician-patient, therapist-client, attorney-client, or other licensed professional relationship.
No particular health, educational, financial, or therapeutic outcome is guaranteed.
24. Food, Allergens, and Equipment
Participants must follow applicable food safety and equipment instructions.
Food may contain allergens or have been exposed to cross-contact.
Raíces will comply with applicable food-handling and safety requirements.
Participants should communicate relevant accommodation or safety needs.
Raíces does not guarantee an allergen-free environment unless expressly stated.
25. Illness and Communicable Disease
Participants should refrain from attendance when their condition presents a material and reasonably identifiable risk to others under applicable public health guidance.
Raíces may apply lawful health and safety requirements.
Disability-related restrictions shall comply with applicable nondiscrimination and individualized assessment standards.
26. Transportation and Personal Property
Unless expressly stated, Raíces does not provide transportation, parking security, or storage of personal property.
Participants are responsible for their own travel arrangements.
Transportation arranged by Raíces, if any, may require additional authorization and safety procedures.
Raíces does not undertake to insure participant property unless expressly agreed.
Nothing excludes liability that cannot lawfully be waived.
27. Program Changes and Cancellation
Raíces may modify, postpone, relocate, substitute personnel for, or cancel Programs for legitimate operational reasons.
Reasonable efforts will be made to notify affected registrants.
Raíces does not undertake to reimburse independently incurred incidental expenses merely because a free Program is canceled, except where required by law or agreement.
28. Waitlists and No-Shows
Waitlist placement does not guarantee admission.
Spaces may be reassigned according to published eligibility and capacity procedures.
Repeated no-shows may result in reasonable registration restrictions when applied consistently and lawfully.
29. Photography and Recording
Programs may involve photography, video, or audio recording.
Optional promotional use of identifiable participant images or recordings requires appropriate authorization.
For minors, legally required parental or guardian consent must be obtained.
Promotional media consent shall be separate from general registration.
Unauthorized recording of other participants, particularly minors, may be prohibited.
30. Email Communications
Raíces may send administrative emails concerning registration, schedules, reminders, waitlists, waivers, cancellations, and Program safety.
Registrants are responsible for providing accurate contact information and reviewing relevant communications.
Email delivery cannot be guaranteed.
Optional promotional communications, if offered, shall comply with applicable consent and unsubscribe requirements.
31. Website Use and Security
Users shall not:
Attempt unauthorized access;
Interfere with website operations;
Submit malicious software;
Impersonate another person;
Access or disclose another person's registration information without authorization;
Misuse confidential registration links;
Circumvent security controls;
Use the platform unlawfully.
Raíces may restrict access when reasonably necessary to protect users or systems.
32. Website Availability
The website may be unavailable due to maintenance, technical defects, third-party outages, or security incidents.
Raíces will use reasonable measures appropriate to its operations but does not guarantee uninterrupted or error-free availability.
Nothing disclaims legally required security, privacy, or consumer protection obligations.
33. Intellectual Property
Raíces' original Program materials, branding, and content remain subject to applicable ownership and licensing rights.
Thrive's name, branding, and intellectual property remain subject to its separate rights.
Software, source code, designs, and technical materials may be owned or licensed by their respective developers or rights holders under separate agreements.
No participant receives ownership rights merely through website access.
34. Privacy
Personal information is governed by the Raíces Sin Fronteras Privacy Policy.
Authorized information sharing may occur with Thrive, instructors, volunteers, venues, or service providers only as reasonably necessary and lawful.
Acceptance of these Terms does not constitute unrestricted consent to disclose personal information.
35. Complaints and Nonretaliation
Participants may report discrimination, harassment, safety concerns, misconduct, privacy concerns, or other grievances to raicescolorado@gmail.com.
Raíces will review reports in good faith.
Good-faith complaints shall not result in retaliation.
A complaint that cannot be substantiated is not automatically considered false.
Knowingly fabricated allegations may be addressed through lawful conduct procedures.
Nothing limits a person's right to contact law enforcement, regulatory agencies, or civil rights authorities.
36. Limited Participant Indemnification
To the extent permitted by law, an adult participant agrees to indemnify applicable Protected Parties against reasonable, legally recoverable third-party claims and losses directly caused by that participant's intentional misconduct, unlawful acts, or material fraudulent representations.
This obligation does not apply to the extent a claim results from a Protected Party's own negligence, misconduct, or independent legal responsibility.
No parent or guardian assumes unlimited personal liability for a minor merely by registering the minor.
37. Limitation of Economic Damages
To the extent permitted by law, Raíces and applicable Protected Parties disclaim indirect or consequential economic damages arising solely from ordinary website interruptions, administrative scheduling changes, or similar routine matters.
This provision does not limit nonwaivable claims, statutory remedies, or liability for bodily injury, death, gross negligence, reckless or intentional misconduct, or unlawful discrimination.
Any release of ordinary-negligence claims is governed by the separate release and applicable law.
38. Relationship to Thrive Policies
Thrive maintains separate website and privacy policies.
Thrive's Website Terms and Conditions are available at:
https://tchnetwork.org/website-terms-and-conditions/
Thrive's general Privacy Policy is available through its website.
These policies are provided for transparency and are not incorporated wholesale into Raíces' Terms merely by reference.
Thrive's policies apply to interactions with Thrive to the extent stated in those policies and under applicable law.
Nothing in these Terms modifies an existing fiscal sponsorship agreement or expands either organization's obligations beyond those established by law or agreement.
39. Governing Law
These Terms are governed by applicable federal law and the laws of the State of Colorado.
The parties may seek informal resolution of disputes, but nothing requires a participant to waive access to courts, regulatory agencies, or legally protected remedies.
40. Severability and Interpretation
If any provision is held invalid or unenforceable, the remaining provisions shall continue to the extent legally permissible.
No provision shall be interpreted to expand a release beyond its lawful scope.
41. Changes to Terms
Raíces may amend these Terms prospectively.
Material changes will be communicated as appropriate.
Changes shall not retroactively expand previously accepted liability releases.
New consent or acknowledgment will be obtained when required.
